1.Responsibilities:
Stephen Young Photography will make every reasonable effort to take photos specifically requested by me,
however, I understand that photo-shoots are somewhat unpredictable events, and that due to the vagaries of the weather, available light, time restrictions and the willingness of subjects, Stephen Young Photography cannot guarantee that ALL requested photographs will be taken, and that no specific pose or photograph can be guaranteed.
I understand that Stephen Young Photography will take the utmost care with respect to exposure, transportation and post-shoot processing all photographs.
However, in the unlikely event that all the photographs have been lost, stolen, damaged or destroyed for reasons beyond Stephen Young Photography’s control, Stephen Young Photography’s liability is limited to either;
a) the return of all payments received for the session, or
b) a second, identical session; choice of option is up to me, the client.
The limit of liability for a partial loss of originals shall be a prorated amount of the package selected, based on the percentage of originals lost.
If Stephen Young Photography or his agent is unable to perform any or all of the duties relating to this agreement for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems; and if he cannot provide another competent professional,
all money received by Stephen Young Photography will be returned to me, and Stephen Young Photography shall have no further liability with respect to this agreement.
2.Coverage:
Stephen Young Photography will provide coverage for the dates, locations and hours specified in this Agreement.
Additional travel or coverage hours may be added, by agreement, on the session day and must be paid in full on delivery of the images.
Images determined by Stephen Young Photography to be substandard or duplicated may be edited out.
Stephen Young Photography will use his professional judgment and sole discretion to select which images to deliver. Such selection shall constitute all images that will be available to me.
3.Payment:
I understand that the agreed upon fee between me and Stephen Young Photography for the session, is due at the time the shoot commences, unless other previous arraignments are made with the Stephen Young Photography.
4.Copyrights and Reproduction:
Stephen Young Photography will give to me, ownership of the digital files and a non-expiring personal license to print, duplicate, and share my photos.
I acknowledge that I am obtaining digital images for personal use only including non-commercial web sites, and shall not sell said images or generate income from them in any form.
If any of Stephen Young Photography’s images are published (on the web or any other media), proper photo credit of “Images by Stephen Young Photography” is required.
I understand that images taken by Stephen Young Photography are the property of Stephen Young Photography and are protected by Copyright Laws.
Stephen Young Photography shall retain the copyrights in perpetuity, regardless of possession or ownership of photographs, digital files or any other format of reproduction.
5.Model release:
This contract serves as a model release giving Stephen Young Photography the irrevocable right to use the photographs in all forms and in all media and in all manners without restriction as to changes or alterations, for advertising, trade, promotion, exhibition or any other lawful purposes.
Stephen Young Photography can grant use of the images to third parties and all compensation for use and credit for the images remain the property of Stephen Young Photography.
I waive any right to inspect or approve the images, or the use to which they may be applied, including written copy that may be created and appear in connection therewith.
That being said, I understand that Stephen Young is a nice guy and he agrees not to allow any identifiable images of me to be used in any manner which may cause embarrassment and/or distress to me.
This release is binding on me, my legal representatives, heirs and assigns.
I recognize and agree that the Stephen Young Photography may reproduce, publish (including internet), exhibit and otherwise use images created without specific identification of persons or events as samples of work to be shown to prospective clients, for instructional purposes and as samples of work to be displayed for marketing or competition.
6.Agreement:
This agreement is not valid until it is signed by the client and Stephen Young Photography.
This is a binding contract and incorporates the entire understanding between the client and Stephen Young Photography.
Any modifications of this contract must be in writing, signed by all parties and attached to the original agreement.
The client signing below will be fully responsible for ensuring that full payment is made according to the terms of this contract.
I assume responsibility for all collection costs and legal fees incurred by Stephen Young Photography should enforcement of this contract become necessary.
In event that any part of this contract is found to be invalid or unenforceable, the remainder of this contract shall remain valid and enforceable.
Any failure by one or both parties to enforce a provision of this contract shall not constitute a waiver of any other portion or provision of this contract.
